What are Digital Right to Work checks?
Digital Right to Work checks provide a fast, secure and fully compliant way for employers to confirm that a prospective employee is legally allowed to work in the UK. As a legal requirement for every new hire, regardless of nationality, industry or job role, these checks form an essential part of the recruitment and onboarding process. With penalties now higher than ever, employers must ensure that each check is conducted correctly, recorded accurately and stored according to Home Office expectations.
Right to Work compliance is not optional. Under the Immigration, Asylum and Nationality Act 2026, employers face fines of up to £45,000 per illegal worker for a first offence and £60,000 per worker for repeat offences. Organisations have only 28 days to pay, although first-time offenders may receive a 30% reduction for early payment. Business names may also be published publicly by the Home Office, causing reputational harm. Completing a compliant check provides employers with a statutory excuse, protecting the organisation from liability should a candidate be found to be working illegally later.
