What is a Level 2 Disclosure Scotland Check?

A Disclosure Scotland Level 2 check (previously known as a Standard Disclosure) is a more detailed criminal record check designed for roles that require a higher level of trust or responsibility but do not involve regulated work with children or protected adults. It replaces most of Scotland’s previous Standard Disclosures under the updated disclosure system introduced on 1 April 2025.

Level 2 disclosures show unspent convictions and certain spent convictions, along with other relevant information such as notification requirements, where applicable. This level of disclosure is typically required for positions such as solicitors, prison workers, or other trusted roles where employers need a fuller picture of an applicant’s criminal history to assess suitability. Eligibility is determined by law and by the organisation overseeing the role. Level 2 Disclosure Scotland includes relevant criminal record checks across Scotland, England, Wales and Northern Ireland. Barred list information is not provided as standard. It is only included if a Level 2 with barred list check is specifically requested.

Security & Vetting Solutions is an accredited body for Disclosure Scotland, which means we are authorised to process criminal record applications on behalf of employers in line with Disclosure Scotland requirements. Applications for Level 2 checks must be initiated by the organisation requesting the disclosure. Unlike Level 1 disclosures, individuals cannot apply themselves. Employers must use disclosure information only for the purpose it was requested, keep it secure, and follow data protection laws and fairness requirements set out under updated Scottish disclosure regulations.

Level 2 with Barred List Disclosure Scotland

A  Level 2 with Barred List Disclosure Scotland check (previously part of the Enhanced Disclosure category before Scotland’s safeguarding reforms) is the highest level of criminal record disclosure available under the updated Disclosure (Scotland) Act 2020 framework. It is required specifically for regulated work involving children and/or protected adults, where an organisation has a legal duty to ensure individuals are safe, suitable and permitted to work in sensitive safeguarding environments. 

This type of disclosure goes beyond basic criminal record checks by providing a detailed assessment of an individual’s criminal history alongside confirmation of their barred list. If a person is listed in the Children’s Barred List, Protected Adults Barred List, or both, they are legally prohibited from working in those regulated roles. For employers, this makes the Level 2 with Barred List check not only a safeguarding best practice, but a mandatory legal requirement before employment can begin.

It reveals whether the applicant is barred from working with children, protected adults, or both, which legally prevents them from holding certain roles. Level 2 check: unspent convictions,  certain spent convictions and some additional information. Level 2 with barred list: everything above plus barred list status. This level is required when the person will engage in regulated activity.

Step 2

Submit application & case management

SVS  submits the application through our accredited Disclosure Scotland system, manages any follow-up queries and monitors progress. You receive regular updates so you always know the status of your check.

Step 3

Results delivered securely & next steps

Once Disclosure Scotland issues the result, we deliver it securely via encrypted email or protected link. We confirm any unspent convictions and provide guidance on record-keeping or next steps, including whether a higher-level check may be appropriate for the role.

Does a Level 2 disclosure include barred list information automatically?

No. Barred list information is only included if the employer requests a Level 2 with barred list check, which is used specifically for regulated work involving children or protected adults.

Is a Level 2 check the same as a Level 2 with a barred list check?

No, because:
Level 2 shows unspent and certain spent convictions.
Level 2 with barred list check includes additional safeguarding information (such as barred list status) and is used for regulated roles, similar to the former Enhanced Disclosure.

Does a Level 2 check replace the old Standard Disclosure?

Yes. Level 2 disclosures have replaced most Standard Disclosures as part of Scotland’s revised disclosure framework under the Disclosure (Scotland) Act 2020.

Can anyone apply for a Level 2 disclosure?

No. Unlike Level 1 disclosures, individuals cannot apply themselves for Level 2.
The application must be started by the employer or organisation requesting it.
